ORDER ADOPTING BUDGET FOR FISCAL YEAR 2008-2009

            On this the 26th day of  September, A.D. 2008, came to be considered the Budget for estimated revenues and proposed County expenditures for the period beginning October 1, 2008, and ending September 30, 2009, and it appearing to the Court that said Budget is in accordance with law, and has been duly prepared by the County Judge, assisted by the County Auditor, on a modified accrual basis consistent with generally accepted accounting principles, and duly filed for inspection; that notice has been given in accordance with law for public hearing on the adoption of said Budget; and the said Budget having been duly considered by the Court with amendments thereto and corrections thereof having been made by the Court, on motion made, seconded and carried by majority vote, it is ordered by the Court that said Budget be, and it is hereby, approved and adopted showing the total appropriation of  $6,231550.89 for the General Fund maintenance and operation budget.  It is further ordered by the Court that the totals shown in said Budget for Personal Services, Supplies, Other Services and Charges, Capitol Outlay and Debt Service be considered to be Budget Line Items, and that amounts shown for individual items included in such totals be considered to be supplementary information.

ORDER TO ADOPT TAX LEVY FOR THE YEAR 2008

            On this the 26th day of September, A.D. 2008, upon motion made and seconded and unanimously passed, it is hereby ordered that the Tax levy rate for the year 2008 be, and it is

hereby set at $ 0.505 on maintenance and operations for a total of  $ 0.505  on each one hundred dollars of assessed valuation of all property subject to taxation in Eastland County.


TAX LEVY FOR THE YEAR 2008

            On this the 26th day of September, A.D., 2008,  the Court being in special called session, Rex Fields, County Judge, Presiding; Wayne Honea, Norman Christian, and Bill Underwood, commissioners and the clerk thereof being present, came on to be considered the matter of fixing the General Tax Levy for the year 2008, when the Court ordered that there be levied and collected for the year 2008 an ad valorem tax for County purposes for the year 2008  and it was ordered by the Court that a tax of   $.0.505 on the one hundred dollars assessed valuation of all property in Eastland County subject to taxation be levied and collected for General Fund purposes. THIS TAX RATE WILL RAISE MORE TAXES FOR MAINTENANCE AND OPERATIONS THAN LAST YEARS TAX RATE. THE TAX RATE WILL RAISE TAXES FOR MAINTENANCE AND OPERATIONS ON A $100, 000 HOME BY APPROXIMATELY      $ -9.72

            It is further ordered by the Court that  $12,000 of  the market value of each residential homestead for which a valid homestead affidavit was timely filed with the Eastland County Appraisal District, of persons sixty-five years of age or older shall be exempt from ad valorem taxes in the amount of exemption levied by Eastland County from and after January 1, 2008, and eligibility for such exemption be determined each year as of January 1 of such year though such date may not operate to nullify the benefits of the homestead exemption.

            It is further ordered by the Court that $12,000 of the market value of each residential homestead for which a valid affidavit was timely filed with the Eastland County Appraisal District, of persons disabled shall be exempt from ad valorem taxes levied by Eastland County from and after January 1, 2008, and eligibility for such exemption shall be determined each year. The individual who is eligible for both the over 65-year old exemption and the disabled person exemption is entitled to only one of the above exemptions, and may choose either.

            There further came on to be considered by the Court the matter of levying occupation taxes, and it is ordered by the Court that there be levied and collected on all occupations made taxable by law, one-half of the occupation tax levied and collected by the State, except in cases where different County tax is provided by law.  It is further ordered by the Court that in such cases there be levied and collected on such occupations the maximum County tax authorized by law.

COURT ORDER

            The above and foregoing action taken in open Court with all members present; County Judge Rex Fields voting “aye”, Commissioner Wayne Honea, Commissioner Norman Christian, Commissioner Bill Underwood, and Commissioner Reggie Pittman all voting “aye”, ordered, declared, and passed this 26th  day of September, 2008.
